Pink Creative Crab (pinkcreativecrab.com) respects the intellectual property rights of others and expects its users and contributors to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA”), the text of which may be found on the U.S. Copyright Office website, we will respond promptly to clear notices of alleged copyright infringement that comply with the DMCA.
This policy describes how to submit a notice of copyright infringement, how to file a counter-notification, and our policy regarding repeat infringers.
1. Reporting Copyright Infringement
If you are a copyright owner, or an agent authorized to act on behalf of one, and you believe that material available on this website infringes your copyright, you may submit a written notification under the DMCA by providing our Designated Copyright Agent (identified below) with the following information in writing (see 17 U.S.C. § 512(c)(3) for further detail):
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has allegedly been infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material — for example, the direct URL(s) on our website where the material appears.
- Information reasonably sufficient to permit us to contact you, such as your full name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages. If you are not sure whether material on this site infringes your copyright, you may wish to contact an attorney before submitting a notice.
2. Designated Copyright Agent
Written notices of claimed copyright infringement should be sent to our Designated Agent:
- Website: Pink Creative Crab (pinkcreativecrab.com)
- Email: info@pinkcreativecrab.com
To ensure a prompt response, please send your notice to the email address above with “DMCA Notice” in the subject line.
3. Counter-Notification
If you believe that material you posted on this website was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our Designated Agent containing the following information (see 17 U.S.C. § 512(g)(3)):
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your full name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original infringement notification or an agent of that person.
Upon receipt of a valid counter-notification, we may forward it to the original complaining party. If that party does not notify us that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed material in our discretion, typically within 10 to 14 business days after receiving the counter-notification.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or contributors who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to this website and/or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.
5. Modifications to This Policy
We reserve the right to modify this DMCA Compliance & Copyright Policy at any time. Any changes will be effective immediately upon posting the revised policy on this page, with an updated “Last updated” date.
This policy is provided for general informational purposes and does not constitute legal advice.
